During the briefing, John Moutsopoulos and Grant Mackinlay of KPMG Australia delivered a presentation and discussion on recent changes to Australia’s regulatory framework for foreign fund managers that wish to raise capital from Australian investors; specifically:

  • Update on ASIC s recent repeal of licensing exemptions for foreign fund managers who have clients in Australia or wish to raise capital in Australia;
  • legal and tax implications for ANREV members with an existing book of clients in Australia including transitional arrangements;
  • legal and tax implications of key options for ANREV members going forward to raise capital in Australia including reliance on other licensing relief, applying for a foreign licence, or setting up a local office and applying for a standard license.

John is a Corporate Funds Partner in the Sydney Office of KPMG Law Australia with extensive funds and investment transaction experience across all asset classes including , real estate , agricultural and other asset classes. John has over 20 years of experience advising on all aspects of funds management, and financial services regulation. John’s specific areas of expertise include fund and investment structuring (including pooled investment trusts, JVs, capital partnerships and clubs (for inbound and outbound investment) and cross border capital raisings and financial services regulation .In addition John assists clients with their regulatory issues arising from entry into the Australian market including financial services regulatory issues and foreign investment advice and applications ).

John was named by his peers as the “Best Lawyers 2021 Sydney Funds Management Lawyer of the Year. 

John is a member of the ANREV Regulatory working group.

 

Grant Mackinlay

Director

KPMG Australia

Grant is a Director in the Sydney office of KPMG Australia’s tax practice with 15 years experience in Australian tax and a focus on assisting non-resident investing in Australian real estate assets.  Grant advises a number of foreign institutional investors including sovereign wealth funds, REITs, pension funds and fund managers across a wide range of assets classes.

 

Grant advises on appropriate structures for non-resident investors, including on the application of the Managed Investment Trust (“MIT”) and Attribution MIT regimes, and also provides due diligence and general advisory advice including on the set up of a local office.

Grant holds a Master of Tax from Sydney University and degrees in Law and Commerce from Australian universities.
